1. Definitions
For the purposes of these Terms:
(a) “Maniac Audio,” “we,” “us,” or “our” refers to Maniac Audio, an independent audio software company.
(b) “Website” refers to maniacaudiovst.com and any associated subdomains.
(c) “Software” or “Products” refers to the VST3/AU audio plugins and related digital products developed and distributed by Maniac Audio.
(d) “User,” “you,” or “your” refers to the individual or entity accessing the Website or purchasing the Software.
(e) “Account” refers to the registered user profile created on our Website.
2. Acceptance of Terms
2.1 By accessing our Website, creating an Account, or purchasing any Product, you confirm that you have read, understood, and agree to be bound by these Terms.
2.2 If you do not agree with any part of these Terms, you must not use our Website or purchase our Products.
2.3 You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to make a purchase from Maniac Audio.
3. Account Registration
3.1 To purchase Products, you may be required to create an Account by providing accurate, current, and complete information.
3.2 You are responsible for:
(a) Maintaining the confidentiality of your account credentials
(b) All activities that occur under your Account
(c) Notifying us immediately of any unauthorized use of your Account
3.3 We reserve the right to suspend or terminate Accounts that violate these Terms, contain false information, or are used for fraudulent activity.
4. Products & Orders
4.1 All Products sold by Maniac Audio are digital downloads. No physical goods are shipped.
4.2 Upon successful payment, you will receive:
(a) An order confirmation email
(b) A download link for the purchased Software
(c) A license that grants you the rights described in Section 6 and our End User License Agreement (EULA)
4.3 Download links are made available through your Account on our Website. It is your responsibility to download and back up your Products in a secure location.
4.4 We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, payment failure, or violation of these Terms.
4.5 Product descriptions, specifications, screenshots, and audio demos are provided for informational purposes. While we strive for accuracy, minor variations between the marketed description and the final Product may occur.
5. Pricing & Payment
5.1 All prices are displayed in the currency indicated on our Website and are subject to applicable taxes and VAT where required by law.
5.2 We reserve the right to modify prices, promotional offers, and discounts at any time without prior notice. Price changes do not affect orders already placed and paid for.
5.3 Payments are processed securely through Stripe. By submitting payment, you authorize the charge of the total order amount to your selected payment method.
5.4 If a payment fails, is reversed, or is subject to a chargeback, we reserve the right to suspend access to the purchased Software and revoke the associated license until the matter is resolved.
5.5 You are responsible for any taxes, duties, or fees imposed by your local jurisdiction beyond those included in the displayed price.
6. License Grant
6.1 Upon purchase, Maniac Audio grants you a non-exclusive, non-transferable, non-sublicensable license to install and use the Software, subject to these Terms and our End User License Agreement (EULA).
6.2 You are permitted to:
(a) Install and use the Software on computers you personally own or control
(b) Use the Software for both personal and commercial audio production
(c) Create backup copies for your personal archival purposes
6.3 You are NOT permitted to:
(a) Resell, rent, lease, lend, sublicense, or redistribute the Software
(b) Share, upload, or distribute the Software or its installer to any third party, file-sharing service, or torrent network
(c) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
(d) Modify, adapt, translate, or create derivative works based on the Software
(e) Remove or alter any copyright notices, trademarks, or proprietary markings
(f) Use the Software for any unlawful purpose
6.4 All rights not expressly granted to you are reserved by Maniac Audio.
7. Refund Policy
7.1 Due to the digital nature of our Products and the immediate availability of download links upon purchase, all sales are final and non-refundable.
7.2 By completing your purchase, you expressly acknowledge and agree that:
(a) You waive your right of withdrawal under EU Directive 2011/83/EU, as the Software is supplied immediately upon purchase
(b) You have reviewed the product descriptions, demos, and free trial versions (where available) before purchasing
(c) You understand that no refunds will be issued for change of mind, compatibility issues with your system, or dissatisfaction with the Product
7.3 Refunds may be considered, at our sole discretion, in cases where:
(a) The Software is demonstrably non-functional and we are unable to resolve the issue within a reasonable time
(b) A duplicate purchase has occurred due to a technical error
(c) Required by applicable consumer protection law

8. System Requirements & Compatibility
8.1 It is your responsibility to verify that your system meets the minimum technical requirements before purchasing. Requirements are listed on each Product page.
8.2 Our Software is distributed in VST3 and AU formats and requires a compatible Digital Audio Workstation (DAW) for operation.
8.3 We do not guarantee compatibility with all DAWs, operating systems, or hardware configurations. Free demo versions are recommended for compatibility testing where available.
8.4 Updates and bug fixes are provided at our discretion and are not guaranteed for any specific timeframe.
9. Intellectual Property
9.1 All content on our Website and within our Software — including but not limited to source code, audio algorithms, graphics, logos, text, designs, presets, documentation, and the “Maniac Audio” name and “Dark series” branding — is the exclusive property of Maniac Audio and is protected by international copyright, trademark, and intellectual property laws.
9.2 Nothing in these Terms grants you any right, title, or interest in our intellectual property, except for the limited license expressly stated in Section 6.
9.3 Any references to third-party hardware, manufacturers, or product names within our Software or marketing materials are made solely for descriptive purposes to indicate sonic character or inspiration. Such references do not imply any affiliation, endorsement, or partnership with the respective trademark owners. All trademarks remain the property of their respective owners.
10. Disclaimer of Warranties
10.1 The Software is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.
10.2 To the maximum extent permitted by law, Maniac Audio disclaims all warranties, including but not limited to:
(a) Implied warranties of merchantability
(b) Fitness for a particular purpose
(c) Non-infringement
(d) Uninterrupted, error-free, or secure operation
(e) Compatibility with any specific system or software
10.3 You acknowledge that you use the Software at your own risk and are responsible for backing up your audio projects and system.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, in no event shall Maniac Audio, its founder, employees, or affiliates be liable for any:
(a) Indirect, incidental, special, consequential, or punitive damages
(b) Loss of profits, revenue, data, or audio projects
(c) Damage to hardware, software, or other digital content
(d) Business interruption or loss of goodwill
arising out of or in connection with the use or inability to use the Software, even if Maniac Audio has been advised of the possibility of such damages.
11.2 Our total aggregate liability for any claim arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the Product giving rise to the claim.
11.3 Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
12. Security Warnings & Installation
12.1 Our Software installers may trigger security warnings on Windows (SmartScreen) or macOS (Gatekeeper) due to the cost-prohibitive nature of code-signing certificates for independent developers.
12.2 These warnings do not indicate that our Software contains malicious code. Installation instructions for bypassing these warnings safely are provided with each Product.
12.3 By proceeding with installation, you acknowledge and accept these warnings and agree that Maniac Audio is not liable for any decisions you make during the installation process.
13. User Conduct
You agree NOT to:
(a) Use the Website or Products in any way that violates any applicable law or regulation
(b) Attempt to gain unauthorized access to any portion of the Website, other user accounts, or our systems
(c) Use automated means (bots, scrapers, crawlers) to access the Website without our prior written consent
(d) Interfere with or disrupt the Website, servers, or networks
(e) Distribute viruses, malware, or any harmful code
(f) Engage in fraudulent activity, including payment fraud or chargeback abuse
(g) Impersonate any person or entity
14. Termination
14.1 We reserve the right to terminate or suspend your Account and license to use the Software, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
14.2 Upon termination:
(a) Your right to use the Software immediately ceases
(b) You must uninstall and delete all copies of the Software in your possession
(c) Sections of these Terms that by their nature should survive termination (including intellectual property, limitations of liability, and dispute resolution) will continue to apply
14.3 Termination does not entitle you to any refund unless required by applicable law.
15. Third-Party Links
Our Website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing such links is at your own risk.
16. Governing Law & Jurisdiction
16.1 These Terms shall be governed by and construed in accordance with applicable European Union law and the laws of the jurisdiction in which Maniac Audio operates, without regard to conflict of law provisions.
16.2 If you are a consumer located in the European Union, you retain the protections afforded by the mandatory consumer protection laws of your country of residence.
16.3 EU consumers may also access the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid one that most closely reflects the original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and End User License Agreement (EULA), constitute the entire agreement between you and Maniac Audio regarding the use of our Website and Products, and supersede any prior agreements or understandings.
19. Changes to These Terms
19.1 We reserve the right to modify these Terms at any time. Updated versions will be posted at maniacaudiovst.com/terms-and-conditions with a revised “Last Updated” date.
19.2 Material changes will be communicated through our Website or via email to registered users where appropriate.
19.3 Your continued use of the Website or Products after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of our services.
